ACCEPTANCE OF THE CONDITIONS OF SALE (T&Cs)

• In the online payment process, the User will be asked to validate these T&Cs by means of a checkbox.
• The T&Cs can be downloaded at any time by the User on the Site in order to allow him to keep them.
• The Company reserves the right to modify these T&Cs at any time.

USE OF THE ONLINE SERVICE

• The Company reserves the right to edit, revise, remove, validate or change, in whole or in part, any content (“Content”) appearing on or displayed on the website.
• The Company may remove, change or modify the Website and/or the service at any time and without notice.

ARTICLE 1.INTRODUCTORY PROVISIONS

• These general conditions of sale (hereinafter the " T&Cs ") apply in their entirety from March 1, 2019, to all activities and services organized within the Carthage Land Park (hereinafter the " Prestations ”) and sold to customers (hereinafter the Customer(s)) by Société Parcs et Loisirs (hereinafter the “ Seller »).
• The Seller offers Customers Leisure Services in the form of tickets (Pass, subscription, package, etc.) and any other ancillary service (catering, etc.).
• The «Access title » refers to a ticket, pass, package or subscription allowing the Customer to access the leisure areas of the Carthage Land Park on a specific date or during a specific period; the " Voucher » or «Voucher» refers to a title exchangeable for one or more Services organized and sold by the Seller.
• Any purchase of one of the aforementioned Services implies the Customer's unreserved acceptance of the T&Cs, notwithstanding any stipulation to the contrary.

ARTICLE 2.IDENTIFICATION OF THE SELLER

The Services covered by these presents are organized and sold to Customers by PARCS ET LOISIRS

ARTICLE 3. ORDER OF SERVICES

The purchase of the Services (hereinafter the “ Order ”) is done:

• at the Vendor's counter on Park opening days; Either in Carthage Land Yasmine Hammamet, Or in Carthage land Les Berges du Lac,
• online on the Website accessible from the following address: www.carthageland.com

3.1 Online order

For any online Order, the Customer is invited to enter his e-mail address and, if necessary, to identify himself using a form to create a personal customer account. In accordance with the legislation and regulations in force, the Customer has the possibility of checking the details of his Order and its total price, and if necessary of correcting the errors before confirming it by thus expressing his acceptance. To finalize the Order, the Customer must read the mandatory pre-contractual information form with regard to the T&Cs, accept them by ticking the boxes provided for this purpose and proceed to payment according to the methods provided for in Article 4.

3.2 Order Confirmation

For any Order of Services online, the Customer receives, by e-mail, an Order confirmation summarizing the contact details of the buyer, the purchases made, the price applied and the essential characteristics of the Services ordered. The confirmation email includes:

• proof of payment,
• Voucher details
• the invoice for the Services ordered,

The Order confirmation email received by the Customer is proof of the entire transaction in accordance with the provisions of Law No. 2000-83 of August 9, 2000 and is the only authentic document in the event of a dispute.

ARTICLE 4. TERMS AND MEANS OF PAYMENT

For any Order of Services, the full price must be paid in one go and in euros or in Tunisian dinar at the time of placing it. Payment can be made by credit card.

• You agree to present the bank card used for payment in order to make sure you are well l’utilisateur légitime of this means of payment.

4.1. Bank card

Subject to contrary indications during the Order, only bank cards from the VISA, CIB and MASTERCARD, e-dinar networks are accepted. The Customer's account will be debited with the price of the Order upon final validation thereof. For any online Order, the proof of payment can be automatically consulted by the Customer, at the end of the Order, on the confirmation page. For any Remote Order, the Customer receives proof of payment by email.

4.2. Securing payments

Electronic payments made within the framework of online Orders on the Seller's Website are secured by the use of the encryption process guaranteeing the confidentiality and security of data.

ARTICLE 5. CONTRÔLE DE TITRE D’ACCÈS ET DE BON D’ÉCHANGE

5.1. Voucher

The Exchange Voucher is always nominative and valid only for the designated person(s).

Any Customer holding an Exchange Voucher must go to the place indicated in the Order confirmation with a valid photo ID, in order to collect a definitive title.

Le bon d’échange est uniquement valable s’il est imprimé sur un papier blanc, vierge recto et verso ou s’il est affiché sur un écran de téléphone mobile de type Smartphone.

5.2. Access title

A dated Access Pass is only valid for the date(s) it mentions. Access passes are checked at the entrance to the Carthage Land Park using bar code readers.

ARTICLE 6. MODIFICATION OF SERVICES

Access Passes and Ancillary Services are not refundable, exchangeable or modifiable.

ARTICLE 7. RESPONSIBILITY

The Seller alone is authorized to determine the conditions of operation and maintenance of the Carthage Land Park, according to its needs and/or constraints and alone decides on the opening schedule and opening hours of the Carthage Land Park to the public; the services and attractions it offers as well as their conditions of use; the prices and terms of sale of the Services it offers to the public within the Carthage Land Park; the maintenance, repair, rehabilitation and renovation program for all or part of the equipment; the implementation of standards and rules concerning in particular the safety and health of people and property in the Carthage Land Park.

The Seller may, at its sole discretion, decide to close public access to all or part of the Carthage Land Park for as long as necessary, in particular for the performance of work necessary for the safety and protection of visitors, or related to the maintenance, repair, renovation, of all or part of the equipment of the Carthage Land Park or in the event of bad weather conditions or cases of force majeure forcing the Seller to the total or partial closure of the Carthage Land Park.

ARTICLE 8. PROTECTION OF PERSONAL DATA

As part of these T&Cs, the Seller is required to collect certain personal information and data from Customers, such as: surname and first name, e-mail, telephone number, address, without this list being exhaustive. These data are processed for the purposes of: managing the Order, access to the Park and sending commercial offers

The data collected to manage the Order will be kept.

The data relating to the bank card will be kept after the transaction for the purposes of proof in the event of dispute of the transaction. The cryptogram is not kept beyond the transaction.

The data collected for commercial prospecting purposes will be kept from the time of their collection.
